GENERAL TERMS AND CONDITIONS BY MARLOES PHOTOGRAPHY

These general terms and conditions apply to all photography-related activities of By Marloes Photography, such as newborn, baby, pregnancy and all other activities.

Article 1 - Privacy statements
All personal and personal data are only used for internal purposes. This means that at no time will information be given to third parties or made available in any way to people not included in this agreement.

Article 2 - General
The model / customer / guardian (hereinafter referred to as customer) will not be able to claim any compensation if the photo session cannot take place due to a technical defect, or if the photos fail, are deleted or damaged as a result. By Marloes Photography undertakes to exclude the chance of any malfunctions or defects as much as possible. This also applies in case of illness or absence of the photographer. In this case, an appointment will be made in consultation with the model / parent / guardian for a new photo session, with the same agreement as for the first session.

During the photo shoots I'm assuming everyone fantsoen, values and we respect each other. If this is not the case, I can cancel the photo session on the spot without a refund of the reportage costs.

By Marloes Photography reserves the right to improve or otherwise change the information on the website at any time. No rights can be derived from the information on the website.

Article 3 - Publication right
The customer gives permission to the photographer to place a self-determined selection of the images on the website, to use them for participation in photo competitions, to publish in trade journals or to show at exhibitions, to place on forums, to use as a portfolio or as an example. in (online) advertisements. (The customer does not receive any compensation for this) The photos on the website are protected by the watermark / low resolution. The photographer cannot be held liable if the images are placed elsewhere on the net without her knowledge.

Article 4 - Copyright
The customer confirms that he / she understands not to be able to claim copyright. The customer uses the purchased large files without watermark exclusively for private purposes. Publication and / or duplication via private social media is permitted, provided it does not concern commercial purposes and the model uses the files supplied for this purpose, including attribution. These are files with the watermark of By Marloes Photography.

Publication and / or duplication for commercial purposes is not permitted without permission from By Marloes Photography.

Receiving the purchased photos, the customer does not automatically give them the rights to the photos. Customer, undertake to keep the digitized photos in their original form. Reductions while retaining the original proportions are allowed; Crops, image editing and adding or removing additional texts and logos are not allowed. The model has no exclusive right to the images taken, nor to the style or edits applied to the photos.

Article 5 - Delivery period
Within three weeks of the date of the photo shoot, you will receive a message that your captured photos are ready and the customer will be given the credentials of their personal online gallery. You are not allowed to save and use photos in this gallery!

The delivery period for the purchased digital files is a maximum of 2 weeks after making your choice, unless otherwise agreed.

The delivery period for purchased or inclusive products depends on the supplier. We do our utmost to deliver the products to you as soon as possible.

Article 6 - Products
Digital photos are understood to mean purchased digital photos, these must be ordered separately and are not included in the standard session costs.

By Marloes Photography always delivers the photos from a photo session digitally in large format (JPG) without watermark. In addition, they are delivered in digital web format (JPG) with watermark (when used on the internet and social media, etc., the customer is obliged to use the web format). The digital files are edited to the style and taste of By Marloes Photography, here you agree as a customer. The photographer determines which selection of photos meet her quality requirements for the customer. A photo gallery contains 15 to 20 edited photos. Unedited photos are not supplied and are not for sale.

The digital files cannot be returned after delivery of the digital files.
The personalized products are ordered especially for you and can therefore not be returned.

Article 7 - Payment
The agreed amount will be paid by bank transfer within two weeks after booking unless otherwise agreed in writing. For last minute bookings, payment must be made within 24 hours.

The photo shoot is only reserved when payment has been made.

Payment by gift voucher is possible, the issued gift vouchers are valid for one year after the date.
The remaining credit can be spent on products, no money will be refunded.

Article 8 - Cancellation

When canceling after official reservation and without valid reason, By Marloes Photography charges 25% cancellation costs of the agreed reportage price. Cancellations can only be made in writing by e-mail.

When canceling or not showing up at the shoot, the following rules apply:
- Cancellation 1 month or more in advance: 25% of the agreed report price.

- Cancellation one month up to 14 days before the shoot date / due date 50% of the agreed reportage price

- Cancellation 14 days to 7 days before the shoot date / due date 75% of the agreed reportage price

- Cancel within a week until the shoot date / due date or no show on the agreed date. Then the full reportage price will be charged and no amount will be refunded.

* In certain situations it is possible to deviate from the cancellation costs, such as illness, death of close relatives, etc.
The photographer will determine when you are entitled to a full refund.

Have you changed your mind and would you like to continue your reservation and appointment after cancellation? Then I charge € 25 administration costs for re-arranging your reservation.

By Marloes Photography reserves the right to cancel a photo shoot with valid reason. By Marloes Photography is not obliged to arrange replacement.

Are you late for your photo shoot?
That can happen, but unfortunately I cannot reverse the time that you are late and so it takes away from your photo session time. (newborn 0-30 minutes, other shoots 0-15 minutes)
-Are you more than 30 minutes late for a newborn session? Unfortunately, I can no longer make a full report and I am forced to cancel the photo session. You are no longer entitled to a refund.

-Are you 15 minutes late for a baby, sitter, child / family shoot? Unfortunately, I can no longer make a full report and I am forced to cancel the photo session. You are no longer entitled to a refund.

In case of force majeure, By Marloes Photography is not obliged to refund payments made. If already paid reservations for photo sessions cannot take place, By Marloes Photography is entitled to move this photo session to a later time or the customer will receive a voucher worth the purchased amount of the current photo session, which is valid for one year. Force majeure means all external influence such as guidelines from the government and all other perceived or unforeseen circumstances over which By Marloes Photography cannot exert influence, as a result of which it is unable to fulfill the agreement made.

Article 9 - Extra costs
The costs that are not included in the package will be charged after the photo shoot. This amount owed must be on the account of By Marloes Photography within a period of 5 working days. Extra costs are costs that are not included in the package, such as parking costs, travel costs or additional digital photos and / or products that are not included in the package. No products will be ordered and / or delivered before the amount due has been received.

Article 10 - Liability
The photographer is not liable for any damage that has arisen for the other party, unless there is gross negligence or intent on the part of the photographer or persons engaged by her. The liability is in any case limited to the amount of the invoice or, if and insofar as there is insured damage, to the amount actually paid out under the insurance.
